Terms of Use
1. Acceptance
By accessing or using the Dawnbringer Tattoo website (the "Site"), creating an account, booking an appointment, submitting a consent form, paying a deposit, uploading any content, or otherwise interacting with our online services, you agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, and our Booking & Refund Policy. These three documents together constitute the entire agreement between you and Dawnbringer Tattoo with respect to your use of the Site.
If you do not agree to any part of these Terms, do not use the Site.
2. The service
Dawnbringer Tattoo is a body art establishment in Kansas City, Missouri, licensed under Missouri 20 CSR 2267. We use this website to display information about our shop and artists, accept bookings, process deposit payments through Stripe, collect legally-required consent and health-screening information, provide patrons with appointment reminders and aftercare, and accept artist applications.
We may modify, suspend, or discontinue any portion of the Site at any time without notice.
3. Eligibility
Age requirement
You must be 18 years of age or older to book an appointment, submit a consent form, or receive any tattooing or body art service from Dawnbringer Tattoo. This is required by Kansas City Code of Ordinances Sec. 50-239, which prohibits tattooing minors regardless of parental consent.
If we discover that an account or booking belongs to a person under 18, we will cancel the booking and terminate the account. Deposit refunds in this case are at our sole discretion and, if issued, will be returned only to the legal guardian named on the payment method, following reasonable verification of identity and guardianship. Attempting to book under false age representation is a breach of these Terms and may forfeit any deposit.
Capacity and sobriety
You represent that you are legally capable of entering into a contract under Missouri law. If you arrive intoxicated at the time of your procedure, we will refuse the procedure and the deposit is forfeit per the Booking & Refund Policy (Missouri 20 CSR 2267-5.020 requires sobriety at procedure).
4. Accounts
When you create a customer account, you are responsible for providing accurate information, keeping your password secure, and all activity that occurs under your account. Notify us immediately at admin@dawnbringertattoo.com if you suspect unauthorized access.
We reserve the right to refuse, suspend, or terminate accounts at our discretion, particularly for repeat no-shows, abusive communication with our artists, or any breach of these Terms.
5. Acceptable use
You agree to use the Site only for lawful purposes. The following are prohibited:
- Attempting to gain unauthorized access to any part of the Site, server, or related infrastructure
- Probing, scanning, or testing vulnerabilities without our written permission
- Interfering with or disrupting the Site (spam, DoS, automated scraping, fake submissions)
- Submitting false information (fake name, fake email, fraudulent payment, fabricated medical attestations)
- Uploading any content that infringes someone else's copyright, contains malware, or violates any applicable law
- Impersonating any person
- Submitting tattoo designs depicting hate symbols, gang affiliation, or content we deem incompatible with our shop's values (we reserve sole discretion on content acceptance)
- Using the Site to harass, threaten, or defame our artists, staff, or other customers
- Filing fraudulent chargebacks
Violations may result in account termination, refusal of future service, forfeiture of any deposit on file, and legal action where appropriate.
6. Booking, deposits, refunds
All bookings, deposits, cancellations, refunds, and tipping are governed by our Booking & Refund Policy, which is incorporated into these Terms by reference. By paying a deposit, you affirm that you have read and agreed to that policy.
7. Content you upload
Reference images and inquiry uploads
When you upload reference images, you represent and warrant that:
- You own the copyright to the image, or you have the legal right to use it for the purpose of commissioning a tattoo, or the image is in the public domain
- The image does not infringe any third party's intellectual property, privacy, or publicity rights
- You grant Dawnbringer Tattoo and the assigned artist a limited, non-exclusive, royalty-free license to use the image for the sole purpose of designing, planning, and discussing your tattoo
We do not claim ownership of your reference images. We do not use them outside of designing your tattoo. We delete them on the retention schedule in our Privacy Policy.
Healing photos
When you upload a healing photo at `/heal/
Artist application portfolios
When you submit an application to join our shop, you grant us a license to review the uploaded portfolio for hiring purposes only. We do not publish or share portfolios from applicants we do not hire.
8. Intellectual property
Our property
The Dawnbringer Tattoo name, logo, website design, text, graphics, code, and other content created by us are owned by Dawnbringer Tattoo and protected by copyright and trademark law. You may not copy, modify, redistribute, or create derivative works of our content without our written permission, except for personal, non-commercial use such as bookmarking a page or sharing a public URL.
Custom tattoo designs
- The physical tattoo on your body is yours. You own the result on your skin. You can show it, photograph it, post it, and live with it however you like.
- The original design (the artwork) may be used by the artist in their portfolio, on social media, and in publications, subject to the photo-release choice you made on your consent form.
- The artist does not have the right to reproduce the same design on another customer's body without consultation with you (the original commissioner), unless you explicitly waive this right.
Flash designs
Flash designs displayed on /flash and made available for booking are the intellectual property of the individual artist who created them. Multiple customers may receive the same flash design from the same artist (depending on whether the flash is one-of-a-kind, limited edition, or open edition).
9. Photo and likeness release
Photos of your tattoo (during the session, after the session, and any healing photos you upload) may be used by Dawnbringer Tattoo and your assigned artist subject to the photo-release option you selected on your consent form. The consent form options are binding.
If you change your mind, email us at admin@dawnbringertattoo.com. We will honor revocation requests going forward, but cannot retract images already published.
10. Vendor relationships
We use the following third-party vendors to operate the Site, as documented in our Privacy Policy §5:
- Stripe — card payment processing and 1099-K issuance to connected artists
- Google Calendar — artist scheduling sync (block-out time only, no personal data)
- Google Analytics 4 (GA4) — aggregate website analytics. Google Signals is disabled; no cross-site advertising IDs are collected and no remarketing is performed. You can opt out via your browser settings or Google's Analytics Opt-out Browser Add-on (see Privacy Policy §7).
- ntfy.sh (or our self-hosted notification service) — push notifications to shop ops staff
- Our SMTP relay provider — delivers transactional email and, if you have opted in, marketing email
Your use of the Site, where it involves these vendors, is also subject to their respective terms of service and privacy policies. We do not run advertising networks, retargeting pixels, social-media tracking pixels (Facebook, Meta, TikTok), heatmap tools, or session-replay tools, and we do not sell or rent your data.
11. Disclaimers
THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The aftercare information provided on our site is general guidance and is not medical advice.
12. Limitation of liability
FOR ANY CLAIM ARISING FROM YOUR USE OF THE WEBSITE OR ONLINE SERVICES (data loss, account issues, website downtime, etc.), OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above may not apply to you. In those cases, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Dawnbringer Tattoo and its owners, practitioners, employees, and affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your breach of these Terms
- Your violation of any law
- Your infringement of any third party's intellectual property, privacy, or publicity rights (particularly via reference images you upload)
- Your false statements on the consent form
- Any claim that any content you submitted caused damage to a third party
14. Termination
We may suspend or terminate your account, refuse to provide services to you, or cancel pending bookings at any time, with or without cause, with or without notice. Reasons may include repeat no-shows, abusive communication, breach of these Terms, suspected fraud, or any reason permitted under Missouri law.
You may close your account at any time by emailing admin@dawnbringertattoo.com.
15. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law principles. Federal law applies where it preempts state law.
Where Missouri state law and Kansas City municipal ordinance both apply, the stricter rule governs (notably, the minor-tattooing prohibition under KC Ord. Sec. 50-239).
16. Dispute resolution
Informal resolution: If you have a dispute with us, you must first contact us at admin@dawnbringertattoo.com and attempt to resolve it informally. We will respond within 30 days.
Venue: If informal resolution fails, any lawsuit must be filed in the state or federal courts located in Jackson County, Missouri. You and Dawnbringer Tattoo both consent to the personal jurisdiction of those courts.
Class action waiver: To the extent permitted by Missouri law, you and Dawnbringer Tattoo each waive the right to participate in any class action, class arbitration, or representative proceeding. Any dispute must be brought in your individual capacity.
17. Miscellaneous
Entire agreement: These Terms, together with our Privacy Policy and Booking & Refund Policy, constitute the entire agreement between you and Dawnbringer Tattoo and supersede any prior agreement.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
No waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
Changes: We may update these Terms from time to time. Material changes will be posted at this URL and communicated to customers with active accounts by email. Your continued use of the Site after changes take effect constitutes acceptance.
